RE: The tariff classification of a pet bowl from India

Dear Ms. Ramsey:

In your letter dated May 21, 2007, you requested a tariff classification ruling.

The merchandise is a stainless steel pet bowl (item number 58620). There is a rubber ring around the base to keep the bowl securely in place on the floor. The rim of the bowl is decorated with embossed paw prints and dog bones. The pet bowl measures approximately 8 inches in diameter at the base and 6 inches in diameter across the top.

The applicable subheading for the pet bowl will be 7323.93.0080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for table, kitchen or other household articles and parts thereof, of iron or steelother, of stainless steel, other. The duty rate will be 2 percent ad valorem.

Articles classifiable under subheading 7323.93.0000, HTSUS, which are products of India may be entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
