RE: The tariff classification of woman’s bib and brace overall from China

Dear Mr. Wang:

In your letter dated May 1, 2007, you requested a classification ruling on behalf of Kerry Textile Inc. Your sample will be returned.

Submitted sample, style #C0609, is a woman’s bib and brace overall constructed from 99% cotton and 1% spandex woven denim fabric. The garment features long legs, a split front bib that rises twelve inches above the waist, adjustable shoulder straps that extend from the back and fasten onto the front and two pockets with buttoned flaps on the bib. The garment also has two front pockets with buttoned flaps below the waist, two rear patch pockets with buttoned flaps, five belt loops and a front button and zipper closure. The garment does not provide the requisite coverage for wear without another outer garment.

The applicable subheading for the style C0609 will be 6204.62.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): trousers, bib and brace overalls, breeches and shorts: of cotton: other: other. The duty rate will be 8.9 percent ad valorem.

Style C0609 falls within textile category 359. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries.
