RE: The tariff classification of gloves from China

Dear Ms. Appel-Schaefer:

In your letter dated April 13, 2007, you requested a tariff classification ruling on behalf of your client, Cloudveil Mountain Works. The provided samples will be returned.

Style CV07252 “Run Don’t Walk” gloves, features a palmside constructed of 88% polyester and 12% spandex knit fabric and a backside made of 100% brushed polyester knit fabric. The backside features an inner windproof breathable membrane (windstopper). The glove is overlaid with textured leather reinforcement on the palm which extends up to the index finger and thumb/forefinger crotch and overwraps a portion of the sidewalls. Other features include fourchettes, a hook and clasp, and an elasticized rib knit cuff bottom. The glove also features a “cloudveil” logo that is located above the center of the backside wrist, and a “windstopper” label sewn onto the side seam of the cuff. The glove is displayed in Cloudveil’s 2007 mountain apparel catalog. The culmination of features on the glove shows a design for use in cross country skiing.

The applicable subheading for the gloves will be 6116.93.0800, Harmonized Tariff Schedule (HTSUS), which provides for Gloves, mittens and mitts, knitted or crocheted: other: of synthetic fibers: other gloves, mittens and mitts, all the foregoing specially designed for use in sports, including ski and snowmobile gloves, mittens and mitts. The rate of duty will be 2.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
