RE: The tariff classification of a textile wall hanging from China or India

Dear Ms. O’Sullivan:

In your letter dated March 21, 2007 you requested a classification ruling.

The submitted sample, referred to as a “silk wall art”, is a textile wall hanging. The item is made from a wooden frame covered with embroidered silk woven fabric. A layer of padding has been added behind the fabric. It will range in size from 12 x 12 inches to 28 x 28 inches. The item is intended to be hung from a wall.

The applicable subheading for the textile wall art will be 6304.99.6030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other furnishing articles, excluding those of heading 9404: other: other: other other: containing 85 percent or more by weight of silk or silk waste. The duty rate will be 3.2 percent ad valorem.

Subheading 6304.99.6030, HTSUS, is not assigned a textile category. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
