RE: The tariff classification of handbag and hat from China

Dear Mr. Starikov:

In your letter dated March 9, 2007, you requested a classification ruling. Your samples are being returned to you.

The sample submitted is a child’s novelty plush handbag. The handbag has double handles and a top zipper closure. The interior storage area has a textile lining. The exterior surface is wholly constructed of man-made fiber textile materials. The handbag has an appliqué of a daisy sewn to the front side. It measures approximately 8” (W) X 6” (H).

The applicable subheading for the handbag will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for handbags, whether or not with shoulder strap, including those without handle, with outer surface of textile materials, other, other, of man-made fibers. The duty rate will be 17.6 percent ad valorem.

You have also submitted a child’s novelty hat. It is constructed of plush knit man-made fiber fabric.

The applicable subheading for the child’s hat will be 6505.90.6090, HTSUS, which provides for hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric, in the piece (but not in strips), whether or not lined or trimmed; hair-nets of any material, whether or not lined or trimmed: other: of man-made fibers: knitted or crocheted or made up from knitted or crocheted fabric: not in part of braid, other: other: other. The duty rate will be 20 cents/kg + 7 percent ad valorem.

HTSUS 4202.22.8050 falls within textile category 670. HTSUS 6505.90.6090 falls within textile category 659. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
