RE: The tariff classification of “Product number BIO-D2-105” from Belgium

Dear Mr. Forbes:

In your letter dated February 22, 2007, you requested a tariff classification ruling.

The subject merchandise is stated to contain 67.5 percent cocoa paste, 26.5 percent sugar, 6.0 percent cocoa powder and traces of soy lecithin. It is shipped in 5-kilogram blocks and it will be used for coating.

The applicable subheading for product number BIO-D-105, will be 1806.20.9900, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Chocolate and other food preparations containing cocoa: Other preparations in blocks, slabs or bars weighing more than 2 kg or in liquid, paste, powder, granular or other bulk form in containers or immediate packings, of a content exceeding 2 kg: Other: Other: Other: Other: The general rate of duty will be 8.5 percent ad valorem.
