RE: The tariff classification of “milk chocolate” (Product number CHM-U4-GOD-105) from Belgium

Dear Mr. Forbes:

In your letter dated February 16, on behalf of Barry Callebaut Canada, of Hyacinthe, Quebec, you requested a tariff classification ruling.

The subject merchandise is stated to contain 44.0 percent sugar, 24.5 percent dry whole milk, 17.5 percent cocoa butter, 13.5 percent cocoa paste, .005 percent soya lecithin and 0.05 percent vanilla flavor. The product is intended for use as coating and only needs to be heated or melted. It will be shipped to the USA in 10-pound slabs.

The applicable subheading for the product “milk chocolate” will be 1806.20.2090, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for Chocolate and other food preparations containing cocoa: Other preparations in blocks, slabs or bars, weighing more than 2 kg or in liquid, paste, powder, granular or other bulk form in containers or immediate packings, of a content exceeding 2 kg: In blocks or slabs weighing 4.5 kg or more each: Containing butterfat or other milk solids. The rate of duty will be free.
