RE: The tariff classification of gloves from China

Dear Mr. Ashear:

In your letter dated February 14, 2007, you requested a classification ruling. The submitted samples will be returned as per your request.

Style AW47M302 is a string-knit glove with a hemmed ribbed knit cuff. You have indicated that the glove is constructed of 87% acrylic, 12% polyester, 1% spandex.

Style AW47M326 is a lined and insulated half-fingered ragg wool glove. You have indicated that the glove is constructed of a string-knit 55% wool, 45% acrylic fabric of multi-colored yarns and has a polyester fleece fabric lining. The glove features a full-fingered thumb and a sewn-on mitten style cover that can be placed over the fingers or secured with a magnetic tab when not in use. The fleece lining extends to trim the bottom edge of the cuff as well as the top edge of the mitten style cover.

The applicable subheading for style AW47M302 will be 6116.93.8800, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Gloves, mittens and mitts, knitted or crocheted: other: of synthetic fibers: other: other: without fourchettes. The duty rate will be 18.6 percent ad valorem.

The applicable subheading for style AW47M326 will be 6116.91.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Gloves, mittens and mitts, knitted or crocheted: other: of wool or fine animal hair. The duty rate will be 31.2 cents per kilogram plus 7 percent ad valorem. Duty rates are provided for your convenience and are subject to change. Style AW47M302 falls within textile category of 631and Style AW47M326 falls within the textile category of 431.
