RE: The tariff classification of a quilted pillow sham from India

Dear Ms. Malina:

In your letter dated February 1, 2007 you requested a classification ruling.

The submitted samples, referred to as Style #196183 “Medallion Quilted Sham,” is a quilted king sized pillow sham. The outer shell is made from 100 percent cotton woven fabric. The face side contains cotton batting and is quilted in an elaborate medallion design. It features an overlapping flap closure with ties on the back. The edges are finished with a flange creating a picture frame effect.

The applicable subheading for the quilted sham will be 9404.90.8040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for mattress supports; articles of bedding and similar furnishing (for example, mattresses, quilts, eiderdowns, cushions, pouffes and pillows) fitted with springs or stuffed or internally fitted with any material or of cellular rubber or plastics, whether or not covered: other: other: of cotton, not containing any embroidery, lace, braid, edging, trimming, piping exceeding 6.35 mm or applique work other. The duty rate will be 4.4 percent ad valorem.

The sham falls within textile category 369. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
