RE: The tariff classification of a costume from China.

Dear Mr. August:

In your letter dated February 2, 2007, you requested a tariff classification ruling.

You have requested a ruling on the following costume, which meets the flimsy, non-durable requirements for classification within Chapter 95, and is being returned, upon your request.

Style 5090Q, Sexy Scarecrow Witch Costume is a textile costume set that consists of a dress, a self-fabric belt and a witch hat, with the dress imparting the essential character. The dress is constructed of a knit polyester top portion and woven polyester dress portion. Although the dress features a defined bust, a well-made neck and two well-made embellishments, it has a flimsy waist, flimsy inside seams and a raw edged hook and loop closure. This dress has a changed waist that is of flimsy construction unlike the well-made waist of style 5090 that was previously ruled upon. The Sexy Scarecrow Witch Costume will be imported in the following styles: 5090Q, adult, packaged in a polybag with an insert. 5090H, adult, packaged on a hanger with an insert. 1574, toddler, packaged in a polybag with an insert. 1574H, toddler, packaged on a hanger with an insert. 5710, plus size adult, packaged in a polybag with an insert. 5710H, plus size adult, packaged on a hanger with an insert. 5927, child, packaged in a polybag with an insert. 5927H, child, packaged on a hanger with an insert. The applicable subheading for style 5090Q, Sexy Scarecrow Witch Costume, and the other styles described above will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other." The rate of duty will be Free.
