RE: The tariff classification of a woman’s suit-type jacket from India

Dear Ms. Malina:

In your letter dated January 12, 2007, you requested a classification ruling. The submitted sample will be returned as requested.

Sample, style #193463 (style #193464 petite), is a woman’s suit-type jacket constructed from 98% cotton and 2% spandex woven fabric. The garment features a full front opening secured by five buttons, long sleeves, a collar and two pockets located beneath the waist. There are four front panels and two back panels.

The applicable subheading for the style 193463 (style 193464 petite) will be 6204.32.2030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): suit-type jackets and blazers: of cotton: other: other: women’s. The duty rate will be 9.4 percent ad valorem.

Style 193463 (style 193464) falls within textile category 335. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
