RE: The tariff classification of an underbed storage bag from China

Dear Ms. Roye:

In your letter dated January 8, 2007, you requested a tariff classification ruling on behalf of your client, Earle Industries, of Earle, Arkansas.

The submitted sample is identified as a “Jumbo Underbed Bag.” The packaging indicates that it is constructed of canvas fabric; our examination of the sample indicates that it is a spunbonded non-woven fabric. You state that it is intended for use for the storage of linens, blankets, sweaters, clothes, and accessories. The item measures approximately 18” x 42” x 6” and is secured with a zipper. The top of the bag is made of clear vinyl plastic. One side has two fabric handles to facilitate sliding the bag under a bed.

The applicable subheading for the underbed bag will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem.
