RE: The tariff classification of a women’s blouse from China

Dear Ms. Jimenez:

In your letter dated January 3, 2007, you requested a classification ruling on behalf of LaROK, a division of L’Koral Incorporated. Your sample will be returned as requested.

Submitted sample, style #KW224-435K, is a women’s blouse composed of alternating panels of knit and woven fabric. The woven panels are constructed from 100% cotton fabric and the knit panels are constructed from 93% polyester and 7% spandex fabric. The pullover garment features a U-shaped neckline, a smocked bodice and 5/8-inch wide detachable shoulder straps.

The applicable subheading for style KW224-435K will be 6211.42.0056, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls: of cotton: other: blouses, shirts and shirt-blouses, sleeves tank styles and similar upper body garments, excluded from heading 6206. The duty rate will be 8.1 percent ad valorem.

Style KW224-435K falls within textile category 341.
