RE: The tariff classification of a woman’s knit garment from China

Dear Ms. Caliari:

In your letter dated December 12, 2006 you requested a tariff classification ruling. We are returning your sample as per your request.

The submitted sample (style 11416) was identified as a woman’s knit zip up jacket/pullover. Due to construction features, this garment is more accurately described as a cardigan.

The cut and sewn cardigan is constructed from 80% cotton and 20% polyester knit fabric whose outer surface measures more than 9 stitches per 2 centimeters in the direction in which the stitches are formed. The garment features a zippered full front opening with a stand up collar, kangaroo front pockets, long sleeves with rib cuffs and a loose fitting ribbed bottom.

The applicable subheading for style 11416 will be 6110.20.2079, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: Women’s: other. The rate of duty will be 16.5%.

Style 11416 falls within textile category designation 339. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
