RE: The tariff classification of a woman’s shirt from China.

Dear Ms. Parker:

In your letter dated December 8, 2006, you requested a classification ruling for a woman’s shirt. The garment will be returned, as requested.

Style PP 357794 is a woman’s shirt constructed from 100 percent cotton rib knit fabric. The shirt has a round neckline, a partial front opening with a 7 button right-over-left closure, and short raglan sleeves, The sleeves and the bottom are hemmed, then finished with a 1 ½ inch panel of contrasting color fabric, giving the appearance of a two layered garment.

The applicable subheading for the shirt will be 6106.10.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Women’s or girls’ blouses and shirts, knitted or crocheted: Of cotton: women’s. The duty rate will be 19.7% ad valorem.

The shirt falls within textile category 339. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
