RE: The tariff classification of an insulated wire assembly from Canada

Dear Mr. Dove,

In your letter dated November 17, 2006, you requested a tariff classification ruling.

The item concerned is a Wiring Harness that consists of two or more insulated wires grouped together within a plastic insulating sheath. There are also integrated circuits built into the length of the sheath that the insulated wires connect to and from.

The purpose of the Harness is to connect a vehicle to an on-board auxiliary power unit and relay electric power.

The applicable classification subheading for the Wiring Harness will be 8544.30.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Insulated wire , whether or not fitted with connectors : other wiring sets of a kind used in vehicles ”. The rate of duty will be 5%.

The Wiring Harness, being wholly obtained or produced entirely in the territory of Canada, will meet the requirements of HTSUS General Note 12(b)(i), and will therefore be entitled to a Free rate of duty under the NAFTA upon compliance with all applicable laws, regulations, and agreements.

This ruling is being issued under the provisions of Parts 177 and 181 of the Customs Regulations (19 C.F.R. 177, 181).
