RE: The tariff classification of a “semi-sweet chocolate coating” (product number 0750280-126) from Canada

Dear Mr. Forbes:

In your letter dated November 13, 2006, on behalf of Barry Callebaut, you requested a tariff classification ruling.

The subject merchandise is stated to contain 42.63 percent sugar, 39.59 percent chocolate liquor, 10.56 percent cocoa butter, 5.07 percent cocoa powder, 1.52 percent anhydrous milkfat, 0.50 percent soya lecithin and 0.09 percent vanilla extract. The total nonfat solids of cocoa powder are 4.51 percent and the total milkfat is 1.52 percent. The product will be in 10-pound slabs and shipped in bulk packages exceeding 2 kilograms. It will be used for coating and enrobing cakes and pastries.

The applicable subheading for the “semi-sweet chocolate coating” will be 1806.20.9900, Harmonized Tariff Schedule of the United States (HTSUS) which provides for Chocolate and other food preparations containing cocoa: Other preparations in blocks, slabs or bars weighing more than 2 kg or in liquid, paste, powder, granular or other bulk form in containers or immediate packings, of a content exceeding 2 kg: Other: Other: Other: Other: The general rate of duty will be 8.5 percent ad valorem.
