RE: The tariff classification of a men’s woven shirt from Indonesia.

Dear Ms. Whitley:

In your letter dated September 13, 2006 and in subsequent information submitted on November 3, 2006, you requested a tariff classification ruling on behalf of Levi’s Red Tab. As requested, your sample is being returned.

Style 81609 is a men’s size Medium shirt constructed of a shell composed of 100% cotton, solid color woven canvas fabric. The garment body is lined with finely knit waffle fabric and the sleeves are lined with a quilted woven taffeta fabric with a light polyester fiberfill. Style 81609 has a left-over-right, full front opening secured by six metal button closures; a hood of finely knit fabric with a lining of waffle knit fabric; a drawstring on the hood; patch pockets on the chest with flaps and snap closures; long vented sleeves with metal button closures on each cuff; and a curved, hemmed bottom with side vents. There is a woven fabric label on the right front panel near the hem.

The applicable subheading for the Style 81609 will be 6205.20.2066, Harmonized Tariff Schedule of the United States (HTSUS), which provides for men’s or boys’ shirts: of cotton: other: other: other: men’s. The duty rate will be 19.7% ad valorem.

Style 81609 falls within textile category designation 340. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries.
