RE: The tariff classification and NAFTA applicability of a motorized clutch assembly from the United States and Canada

Dear Ms. Kennette,

In your letter dated July 31, 2006, you requested a tariff classification ruling.

The item concerned is the Control Drive Unit (CDU) Assembly Motor/Clutch – RS PSD [989602U]. It is a geared, clutch assembly powered by a brushless, DC motor outputting less than 18.65 Watts.

The purpose of the Control Drive Unit (CDU) Assembly Motor/Clutch – RS PSD [989602U] is to automatically slide open the right side panel door of a vehicle.

The applicable classification subheading for the Control Drive Unit (CDU) Assembly Motor/Clutch – RS PSD [989602U] will be 8501.10.4040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Electric motors : Motors of an output not exceeding 37.5 W: Of under 18.65 W: Other: DC: Brushless”.

Each of the non-originating materials used to make the Control Drive Unit (CDU) Assembly Motor/Clutch – RS PSD [989602U] has satisfied the changes in tariff classification required under HTSUS General Note 12(t), Chapter 85., Chapter rule 7, 1. (A). The Control Drive Unit (CDU) Assembly Motor/Clutch – RS PSD [989602U] will be entitled to a Free rate of duty under the NAFTA upon compliance with all applicable laws, regulations, and agreements.

This ruling is being issued under the provisions of Parts 177 and 181 of the Customs Regulations (19 C.F.R. 177, 181).
