RE: The tariff classification of mini permanent markers in a plastic bowl from China

Dear Mr. Crago:

In your letter dated March 30, 2006, you requested a tariff classification ruling.

You are requesting the tariff classification on merchandise that is comprised of the following parts: seventy five mini permanent markers that will be packaged and sold in a clear plastic display (“fish”) bowl. The designated item number for the merchandise is C068JA01393. A sample has not been provided; instead an illustration was submitted.

The product is not considered a set for tariff purposes; each part (the permanent markers and the plastic display bowl) will be separately classified.

The applicable subheading for the mini permanent markers portion of item number C068JA01393 will be 9608.20.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for felt tipped and other porous-tipped pens and markers. The rate of duty will be 4% ad valorem.

The applicable subheading for the plastic bowl portion of item number C068JA01393 will be 3926.90.9880, Harmonized tariff Schedule of the United States (HTSUS), which provides for other articles of plastics and articles of other materials of headings 3901 to 3914: other: otherother. The rate of duty will be 5.3% ad valorem.
