RE: The tariff classification of a woman’s maternity dress from Bangladesh

Dear Ms. Caliari:

In your letter dated October 9, 2006, you requested a classification ruling. The submitted sample will be returned to you as requested.

Style 96208 is a woman’s maternity dress constructed from 100 percent cotton woven fabric. The dress features a shaped front neckline, 1-inch wide adjustable shoulder straps, an empire waist with self-fabric ties and two front patch pockets.

The applicable subheading for the dress will be 6204.42.3050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers,, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): dresses: of cotton: other: other: other: other: women’s. The duty rate will be 8.4 percent ad valorem.

Style 96208 falls within textile category 336. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
