RE: The tariff classification of a garden stake from China

Dear Mr. Stinson:

In your letter dated September 15, 2006, you requested a tariff classification ruling.

The sample you submitted, which will be returned to you, is described as a Pineapple Garden Stake (LISS item number A26F0304, Mfg. item number C26F6403). It is a base metal garden stake with a powder coated, rusty finish. It measures approximately 39-1/4 inches high. At its top is a pineapple made of wire and decorated with several plastic gem-like ornaments.

The applicable subheading for the garden stake will be 8306.29.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for bells, gongs and the like, nonelectric, of base metalstatuettes and other ornaments, and parts thereof, other. The rate of duty will be free.
