RE: The tariff classification of a woman’s coat from Vietnam

Dear Ms. Boullet:

In your letter dated September 12, 2006, you requested a classification ruling.

The sample submitted, style number WL3108, is a woman’s short coat constructed of a shell composed of a woven 60% polyester/20% cotton/20% nylon fabric that has a visible polyurethane coating on the inner surface. The shell fabric has also been treated with a DWR application. The coat is fully lined with a woven 100% polyester satin fabric.

The coat extends to the thigh area in length and has a fold-down pointed collar with a button tab closure on the front portion of the neck, a full front opening secured by a zipper closure and an overlapping flap with a right-over-left, five-button closure that covers the zipper area. The coat has four front pockets below the waist, two of which have a flap with a button tab closure, long hemmed sleeves with an adjustable button tab closure at the wrist area, four inner pockets, two of which have a zipper closure, a self-fabric rear belt with a one-button closure at the waist area, and a straight cut hemmed bottom with a rear vent that has a three-button closure.

The sample is being returned to you as you have requested.

The applicable subheading for the coat will be 6210.30.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Garments, made up of fabrics of heading 5602, 5603, 5903, 5906 or 5907: Other garments, of the type described in subheadings 6202.11 to 6202.19: Of man-made fibers: Other. The duty rate will be 7.1 percent ad valorem.

The coat falls within textile category 635. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
