Dear Ms. Fox:

This letter replaces NY M84734 that was issued to you on July 28, 2006 on behalf of Peninsula Global, Inc. In that letter, Style LCS07985 was not considered knit to shape because the neckband on the submitted garment did not have a self-start bottom.

On August 22, 2006, you submitted a new sample garment and new components for this style. An examination of the new garment indicates that Style LCS07985 is now constructed with a knit to shape neckband. Your sample has been retained for our files.

Style Number: LCS07985

Garment Description: Men’s pullover, 100% cotton; double knit fabric, jersey knit mitered V-neckline, long sleeves with tubular knit cuffs, tubular knit bottom.

Garment Construction: All components are knit to shape and assembled by linking and looping Front and back panels have clear and continuous lines of demarcation at the front and back necklines. Sleeves have full fashion marks at the armholes. Neckband has a self-start bottom and self-finished sides.

The merchandise, in its condition as imported into the United States, should conform to the facts and the description as set forth both in the ruling request and in this ruling. In the event that the facts or merchandise are modified in any way, this should be brought to the attention of Customs officials. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). The holding set forth above applies only to the specific factual situation and merchandise as identified in the ruling request. This position is clearly set forth in 19 CFR 177.9(b)(1) which states that a ruling letter is issued on the assumption that all of the information furnished in connection with the ruling request and incorporated therein, either directly, by reference, or by implication, is accurate and complete in every material respect.
