RE: The tariff classification of a robe for girls’ wear from Macau

Dear Ms. Fox:

In your letter dated August 22, 2006, written on behalf of Sugartown Worldwide, Inc., you requested a classification ruling.

Submitted style 65266P, manufactured from knitted terry of 74% cotton/23% nylon/3% spandex, is a dress-length garment, characterized by a full-front, zippered opening that extends from the flounce of the lower edge of the garment to the neckline, by a hood, by short sleeves, and by a pocket at the lower portion of each of the fronts.

As you have requested, the sample garment is being returned.

The applicable subheading for this style will be 6108.91.0040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for girls’bathrobes, dressing gowns and similar articles, knitted, other, of cotton, other, girls’. The duty rate will be 8.5 per cent ad valorem.

The robe falls within textile category 350. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
