RE: The tariff classification of a kitchen towel from China.

Dear Ms. Parmann:

In your letter dated August 24, 2006 you requested a classification ruling.

You submitted a sample of a kitchen towel referred to as SKU MSK-RJKT-06. The flat woven towel measures approximately 15 x 24.5 inches. It is made from 100 percent cotton jacquard woven fabric. All four sides are hemmed. The submitted towel has a holiday jacquard design, however, you have asked for the classification of a kitchen towel with a non-holiday jacquard design.

The applicable subheading for the towel will be 6302.91.0035, Harmonized Tariff Schedule of the United States (HTSUS), which provides for bed linen, table linen, toilet linen and kitchen linen: other: of cotton other: towels: jacquard figured. The duty rate will be 9.2 percent ad valorem.

The towel falls within textile category 363. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
