Dear Ms. Fox:

In your letter dated July 31, 2006, on behalf of Ann Taylor, Inc., you requested a classification ruling. Your sample is being returned as requested.

The submitted sample, style number 27-154767, is a woman’s dress that extends to the mid-thigh area. It is constructed from 56% polyacrylic, 24% polyamide and 20% mohair knit fabric. The dress features a ribbed cowl collar, long sleeves with ribbed cuffs, and a ribbed bottom. A partial cable knit pattern is on the front panel and sleeves.

The applicable subheading for the dress will be 6104.43.1010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s dresses, knitted: of synthetic fibers: containing 23 percent or more by weight of wool or fine animal hair: women’s. The duty rate will be 14.9% ad valorem.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

The dress falls within textile category designation 436. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
