RE: The tariff classification of a woman’s suit-type jacket from China

Dear Mr. Lall:

In your letter dated July 31, 2006, you requested a classification ruling. Your sample is being returned as requested.

The submitted sample, style number 4467, is a woman’s tailored suit-type jacket. It is constructed from 92% cotton, 5% polyester, knit fabric with sequins. The garment has more than three panels that are sewn together lengthwise. The garment features a notched-lapel collar, long sleeves lined with woven fabric and 3 button cuffs, a full front opening with 3 button closures, princess seams on the back panels, and a hemmed bottom. The upper portion of the garment is lined with jersey knit fabric.

The applicable subheading for the suit-type jacket will be 6104.32.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s suit-type jackets, knitted: of cotton. The duty rate will be 14.9% ad valorem.

The suit-type jacket falls within textile category designation 335. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
