RE: The tariff classification of an electronic game from China.

Dear Ms. Shafran:

In your letter dated June 19, 2006 you requested a tariff classification ruling.

The product under consideration, identified as Naruto™ Ninja Challenge™ Interactive Gloves & Chakra Launcher, model number J7838, is an electronic role play game that is said to allow a player to train and test his skills as a Ninja apprentice. The game consists of two soft gloves containing embedded electronics and a Chakra launcher base that holds 30 plastic disc projectiles. The gauntlets function as remote controllers and, through 64 hand signals, trigger audio feedback from the Chakra base launcher and command the launcher to launch projectiles toward and away from the user as interactive game play. A sample of the game will be returned at your request.

The applicable subheading for the Naruto™ Ninja Challenge™ game will be 9504.90.4000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Articles for arcade, table or parlor gamesother: game machines, other than those operated by coins, banknotes (paper currency), discs or similar articles; parts and accessories thereof.” The rate of duty will be free. In answer to your concern on the tariff status of the gloves used in this game, we consider the interactive gloves as game components classifiable in heading 9506, HTSUS, and not subject to the exclusionary language of Legal Note 1(u) of Chapter 95, HTSUS.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
