RE: The tariff classification of bottle wraps from India or China

Dear Mr. Patel:

In your letter dated June 13, 2006, you requested a tariff classification ruling.

The submitted samples are identified as terry bottle sleeves. You state that the items are intended for use as a sleeve to fit over standard sports drink bottles and for use as a handy material to wipe off sweat while jogging or exercising. You indicate that they are constructed of 100% cotton terry, either knitted or woven. There is elastic trim on the sides near the bottom of the items for gripping bottles. The necks are 100% cotton knitted jersey fabric. The submitted samples measure approximately 3 ½”W x 8”L. They will be produced and imported in three different sizes and identified as the Prosweat #s S100 (size 24 oz. sports bottle), S200 (size 26 oz. sports bottle), and BM300 (size 32 oz. sports bottle).

The applicable subheading for the terry bottle sleeves will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
