RE: The tariff classification of wire racks from China

Dear Mr. Griffith:

In your letter dated June 7, 2006, you requested a tariff classification ruling.

The samples you submitted, which will be returned to you, are two wire racks made of base metal. Item number 81-7790 is described as an “8 Position Steering Wheel Cover Display Rack.” It measures approximately 14 inches tall by 15 inches wide by 12 inches deep. Item number 81-7731 is described as a “6 Position License Plate Display Rack.” It measures approximately 30 inches tall by 14 inches wide by 9 inches deep. Your letter states that they will be hung on pegboards and used by retail outlets for display.

The applicable subheading for the base metal racks will be 8302.50.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for base metal mountings, fittings and similar articleshat-racks, hat pegs, brackets and similar fixtures, and parts thereof. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
