RE: The tariff classification of a curtain from India.

Dear Ms. Scott:

In your letter dated June 7, 2006 you requested a classification ruling on behalf of Scout Ltd Inc.

You submitted a sample of a “fishtail” swag. The lined swag is made from 100 percent cotton woven fabrics. The face fabric is printed with stripes. It measures approximately 25 inches wide by 148 inches in length.

The applicable subheading for the swag will be 6303.91.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for curtains (including drapes) and interior blinds; curtain or bed valances: other: of cotton window curtains (including drapes) and window valances. The rate of duty will be 10.3 percent ad valorem.

The swag falls within textile category designation 369. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
