RE: The tariff classification of a woman’s dress from China

Dear Ms. Henry:

In your letter dated May 18, 2006, you requested a classification ruling. The submitted sample will be returned to you as requested.

Style E6611 is a woman’s dress constructed from 100 percent cotton woven printed fabric. The sleeveless dress features a shaped front neckline, spaghetti straps, a side zipper closure and beading around the waist. The knee length dress is entirely covered with a see-through overlay constructed from 100 percent nylon tulle fabric. The overlay is securely attached at the neckline and at the waist. The cotton woven fabric imparts the essential character to the garment.

The applicable subheading for the dress will be 6204.42.3050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): dresses: of cotton: other: other: other: other: women’s. The duty rate will be 8.4 percent ad valorem.
