RE: The tariff classification of plastic bowls with lids from China.

Dear Ms. Marcoux:

In your letter dated May 19, 2006, you requested a classification ruling.

The submitted illustration depicts a set of 5 colorful microwave bowls with lids identified as item number 54870. The bowls and lids are made of polypropylene. The lids feature a silicone seal to lock-in freshness and are vented to allow steam to escape and ensure better heat circulation for more even cooking. These plastic bowls are designed with a built in handle. They can be used from freezer to microwave without lifting the cover. The approximate capacity of each bowl is as follows: purple (1 quart), red (16 ounces), green (12 ounces), tan (6 ounces) and pink (6 ounces). All of the plastic bowls with lids are dishwasher and freezer safe.

The applicable subheading for the plastic bowls with covers will be 3924.10.4000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for tableware, kitchenware, other household articlesof plastics: tableware and kitchenware: Other. The rate of duty will be 3.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
