RE: The tariff classification of radar devices from Mexico.

Dear Mr. Johnson:

In your letter dated April 12, 2006 you requested a tariff classification ruling.

The items in question are two varying types of radar devices. The first is a personal battery operated radar device that when manually activated emits a radar beacon. While on the person it emits a radar beacon that provides an exact location of the person for the purpose of an emergency rescue situation.

The second radar device is battery operated vessel mounted radar location device. When manually operated it provides an exact radar location in the event of a vessel emergency. The radar signal is within the 9.2-9.5 GHz range with a dome range of one mile. The emitted signal is readable by any standard radar.

The applicable subheading for the vessel mounted radar device will be 8526.10.0020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Radar apparatus, radio navigational aid apparatus and radio remote control apparatus: Radar apparatus Designed for boat or ship installation. The rate of duty will be free.

The applicable subheading for the personal radar device will be 8526.10.0040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Radar apparatus, radio navigational aid apparatus and radio remote control apparatus: Radar apparatus Other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
