RE: The tariff classification of a Marumerizer from Japan

Dear Mr. Lander:

In your letter dated April 17, 2006 you requested a tariff classification ruling.

The Marumerizer is a production scale spheronizer which converts wet pellets into spheres. The machine has a wide range of applications and is capable of working with materials such as pharmaceuticals, detergent enzymes, fertilizer, food additives, ceramic substrates, and water dispersible pesticides. The machine consists three main components: a vertical cylinder with discharge port, a circular “friction” plate and a variable speed drive train which turns the plate. Feed material (extruded particles or moist granules from a mixer/granulator) are fed onto the spinning friction plate which in turn hurls the particles against the inside wall of the cylinder. The plate which has a specific grid size rotates at up to 16,000 rpm. The use of centrifugal and gravitational forces result in the formation of a mechanically fluidized ring of particles. The combination of grid size and the collisions with the wall, friction plate and other particles result in the deformation of each granule. Each granule is quickly transformed into the desired spherical shape.

The applicable subheading for the Marumerizer will be 8479.89.9897, Harmonized Tariff Schedule of the United States (HTSUS), which provides for machines and mechanical appliances having individual functions, not specified or included elsewhere (in chapter 84): other machines and mechanical appliances: other: other: other: other. The rate of duty will be 2.5 percent ad valorem.
