RE: The tariff classification of a men’s outerwear jacket from China

Dear Mr. Pilant:

In your letter dated April 4, 2006 on behalf of Jhane Barnes Menswear, Inc., you requested a classification ruling. A sample was submitted and is being returned as you requested.

The item in question, style #28077, is a men’s outerwear jacket with a shell made from a woven fabric with a 42% polyacrylic/37% nylon/21% viscose fiber blend. The jacket is unlined, but the shell fabric has a velvet-like inner surface. The garment has a full front opening with a zipper closure, a standup collar, long sleeves with snaps at the cuffs, zippered pockets at the waist and a hemmed bottom. The jacket is trimmed with leather stripping at various points.

The applicable subheading for the jacket will be 6201.93.3511, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other men’s anoraks (including ski-jackets), windbreakers and similar articles, of man-made fibers. The duty rate will be 27.7 percent ad valorem.
