RE: The tariff classification of a woman’s sweater from China

Dear Ms. Williams:

In your letter dated March 31, 2006, you requested a classification ruling. Your sample is being returned as requested.

The submitted sample, style number WF6AP1720MI, is a woman’s sweater that is constructed from 55% cotton, 25% viscose, 10% nylon, 5% wool, 5% angora, openwork crocheted fabric. The outer surface of the fabric measures fewer than 9 stitches per 2 centimeters in the horizontal direction. The garment reaches the waist and features a modified shawl collar, short sleeves, and a full front opening with no means of closure.

The applicable subheading for the sweater will be 6110.20.2020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, crocheted: of cotton: other: sweaters: women’s. The duty rate will be 16.5% ad valorem.

The sweater falls within textile category designation 345. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
