RE: The tariff classification of two tote bags from China

Dear Mr. Clarke:

In your letter dated February 20, 2006, you requested a classification ruling. The request is on behalf of For Keeps LLC of Anaheim, CA.

The two submitted samples are not identified with style numbers. Both items are open top tote bags of a type sold at retail as a “gift bag” as well as a tote bag. Each item is designed for repetitive reuse as a tote bag. Each tote has a ball chain with a luggage tag type holder affixed to one of the double handles. The item that you refer to as the Perfect gift bag measures 12” W x 10” H x 5.5 x D and is wholly of heavy gauge polyvinyl chloride (pvc) plastic sheeting. The front and back panels are double layer with a middle of sheeting. The item that you refer to as the Petite gift bag measures 6” W x 6” H x 3” D and is wholly of man-made fiber textile materials with reinforced bottom stiffeners.

The applicable subheading for item that you refer to as the Perfect gift bag will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTSUS), which provides, in part, for travel, sport and similar bags, with outer surface of textile materials or of sheeting of plastic, other. The duty rate will be 20 percent ad valorem.

The applicable subheading for item you refer to as the Petite gift bag will be 4202.92.3031 Harmonized Tariff Schedule of the United States (HTSUS), which provides, in part, for travel, sport and similar bags, with outer surface of textile materials, other, of man-made fibers. The duty rate will be 17.6 percent ad valorem.
