RE: The tariff classification of a woman’s pullover from China

Dear Ms. Bauman:

In your letter dated March 7, 2006, you requested a classification ruling on behalf of Dress Barn Inc. As requested, your sample is being returned to you.

Your sample, style 7034, is a woman’s pullover constructed from 55% rayon, 45% nylon knit fabric. The outer surface of the garment measures more than nine stitches per two centimeters in the direction in which the stitches were formed. The garment features a V-shaped ruffled neckline, ¾ length sleeves and a self-start bottom. The back panel of the garment does not meet the requirements of statistical note 6, Chapter 61, Harmonized Tariff Schedule of the United States (HTSUS).

The applicable subheading for style 7034 will be 6110.30.3059, HTSUS, which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: Of man-made fibers, Other, Other, Other, Other, Other, Women’s or girls’, Other. The duty rate will be 32% ad valorem.

Style 7034 falls within textile category designation 639. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
