RE: The tariff classification of wetsuits from Taiwan

Dear Ms. Park:

In your letter dated March 7, 2006 you requested a classification ruling.

Submitted styles “Shore Break” 805001S/806001S, manufactured from finely knitted fabric of 92% nylon/8% nylon, are one-piece, legged, short-sleeved garments that open by means of a zipper that extends from the area of the waist to the stand-up neckline.

As you have requested, the sample garments are being returned.

The applicable subheading for the “Shore Break” styles will be 6114.30.3030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other garments, knitted, of man-made fibers, other, ..one-piece playsuits and similar apparel, girls’. The duty rate will be 14.9 percent ad valorem.

These garments fall within textile category designation 237. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
