RE: The tariff classification of a nylon/rayon blend raschel knit fabric from Columbia.

Dear Mr. Nagel:

In your letter dated March 6, 2005 you requested a tariff classification ruling. The sample is being returned as requested.

The submitted sample, designated as style LW1095, is an open-work warp knit fabric composed of 64.1% nylon and 35.9% rayon. This raschel knit fabric is characterized by an inwrought design featuring a floral motif. The product contains yarns of different colors. Weighing approximately 68 g/m2, this item will be imported in 335 centimeter widths.

The applicable subheading for the warp knit fabric designated as style LW1095 will be 6005.33.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for warp knit fabrics (including those made on galloon knitting machines), other than those of headings 6001 to 6004, of synthetic fibers, of yarns of different colors, open-work fabrics. The rate of duty will be 10 percent ad valorem.
