RE: The tariff classifications of infants’ wear from China

Dear Ms. Nunez:

In your letter dated January 31, 2006, you requested a classification ruling on three collections of infants’ wear that will be sold together at the retail level as sets.

Submitted style JA1501D consists of a coverall, a bodysuit, a hat, socks and a receiving blanket. The articles, except for the socks, are made of cotton knit fabric. Style JA9601MV consists of a coverall, two creepers, a bib, a hat and socks. The articles, except for the socks, are made of cotton knit fabric. Style V11510 consists of a coverall and socks. The coverall is made of 80% cotton, 20% polyester knit fabric. The socks, styles JA1501D, JA9601MV and V11510, are made of 80% cotton, 18% nylon, 2% spandex knit fabric.

The submitted styles are being retained for reference purposes.

The applicable subheading for the style JA1501D bodysuit and the style JA 9601MV creepers will be 6111.20.6010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for babies’ garments and clothing accessories, knitted or crocheted, of cotton, other, sunsuits and similar apparel. The duty rate will be 8.1 percent ad valorem.

The applicable subheading for the style JA1501D coverall, the style JA 9601 MV coverall and bib and the style V11510 coverall and socks will be 6111.20.6070, Harmonized Tariff Schedule of the United States (HTSUS), which provides for babies’ garments and clothing accessories, knitted or crocheted, of cotton, other, other, other. The duty rate will be 8.1 percent ad valorem.

The applicable subheading for the style JA1501D and style JA 9601MV socks will be 6111.20.6050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for babies’ garments and clothing accessories, knitted or crocheted, of cotton, other, other, babies’ socks and booties. The duty rate will be 8.1 percent ad valorem.

The applicable subheading for the style JA1501D receiving blanket will be 6301.30.0020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for blankets (other than electric blankets) and traveling rugs, of cotton, other. The duty rate will be 8.4 percent ad valorem.

The applicable subheading for the style JA1501D and style JA9601MV hat will be 6505.90.1515, Harmonized Tariff Schedule of the United States (HTSUS), which provides for hats and other headgear, knitted or crocheted, other, of cotton, knitted, for babies’. The duty rate will be 7.9 percent ad valorem.

All apparel including headwear falls within textile category designation 239. The cotton receiving blanket falls within category 369.
