RE: The tariff classification of a woman’s sweater from Vietnam

Dear Mr. Stack:

In your letter dated January 18, 2006, on behalf of Item Eyes, Inc., 463 Seventh Avenue, New York, NY 10018, you requested a classification ruling. Your sample is being returned as requested.

The submitted sample, style number M0149, is a woman’s sweater that is constructed from 60% cotton, 40% polyester, openwork knit fabric. The garment features a V-neckline, long sleeves, and a full front opening with a tie closure. The neckline, placket, and sleeves have scallop edges.

The applicable subheading for the sweater will be 6110.20.2020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, knitted: of cotton: other: sweaters: women’s. The duty rate will be 16.5% ad valorem.

The sweater falls within textile category designation 345. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
