RE: The tariff classification of cotton hats from China.

Dear Ms. Hu:

In your letter dated December 2, 2005, you requested a tariff classification ruling. As requested, the samples will be returned to you.

You have submitted five samples. Styles 9546 Baseball Cap and 9547 Baseball Cap are baseball-style caps constructed of woven 100% cotton fabric. The caps feature six panels, stitched peaks, fabric covered buttons at the top, an adjustable back strap and sweatbands. Styles 9548 Bucket and 9549 Bucket are bucket-style hats constructed of woven 100% cotton fabric. The partially lined hats feature sweatbands and stitched brims. Style 9554 Dress is a fedora-style hat constructed of woven 100% cotton fabric.

The applicable subheading for all styles will be 6505.90.2060, Harmonized Tariff Schedule of the United States (HTS), which provides for hats and other headgear, knitted or crocheted, or made up from lace felt or other textile fabric, in the piece (but not in strips), whether or not lined or trimmed; hair-nets of any material, whether or not lined or trimmed: other: of cotton, flax or both: not knitted: and headwear of cotton, other. The rate of duty will be and 7.5% ad valorem.

All styles fall within textile category designation 359. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
