RE: The tariff classification of Santa water globes from China.

Dear Mr. Crago:

In your letter dated January 17, 2005, you requested a classification ruling.

You have submitted photographs depicting two styles of Santa water globe decorations identified as assortment number W072AA02792. The Santa water globes are composed of a polyresin base with a glass globe. The scenes inside the glass globes depict the upper torso of Santa dressed in his traditional red and white suit and hat. Santa’s legs are attached with springs to the base, which is the lower torso of Santa. The Santa water globes measure 2-3/4” x 1-3/4” x 2-7/8”.

The applicable subheading for assortment number W072AA02792, Santa water globes will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: Other: Other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
