RE: The tariff classification of a hanging ornament from China

Dear Mr. Stinson:

In your letter, dated November 8, 2005, you requested a tariff classification ruling.

The samples you provided are two hanging ornaments made of metal wire and glass; one has a copper finish, the other a chrome finish. You describe them in your letter as “metal spiral spinners.” Both items have the same manufacturer item number (C26Z0905-1052) and importer item number (943716). Each measures approximately 14 inches long and consists of a 2-½ inch wire hook, a 9-inch twisted, wire spiral that spins, several wire-wrapped glass balls and a small, wire-wrapped glass figure. When it moves, the metal spiral component of the product creates a unique visual effect. The metal spiral is the predominant decorative feature of this item and, therefore confers its essential character.

The applicable subheading for the base metal hanging ornament will be 8306.29.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for bells, gongs and the like, nonelectric, of base metal; statuettes and other ornaments, of base metalstatuettes and other ornaments, and parts thereof, other. The rate of duty will be free.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Barbara Kaiser at 646-733-3024.
