RE: The tariff classification of a handbag with decorations from China.

Dear Ms. Aldinger:

In your letter dated November 15, 2005, you requested a classification ruling for a handbag with decorations.

The sample submitted is identified as item # 19568 (920198) “Denim Bag”. The item consists of a denim handbag constructed of 80% cotton and 20% polyester with decorations. Included in this kit is the denim handbag in addition to beads, glitter glue, rhinestones, fabrique appliqués, glitter tattoos, ribbons and pom poms to decorate and personalize your own bag. For classification purposes the items are considered to be an unfinished handbag and will be classified accordingly. Your sample is being returned as requested.

The applicable subheading for the handbag will be 4202.22.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strap, including those without handle, with outer surface of textile materials, of vegetable fibers and not of pile or tufted construction, of cotton. The duty rate will be 6.3 percent ad valorem.

HTS 4202.22.4500 falls within textile category designation 369. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
