RE: The tariff classification of an Abalone Disk Necklace from China.

Dear Ms. De Silva:

In your letter dated November 22, 2205, you requested a tariff classification ruling.

The submitted sample, identified as Abalone Disk Necklace, PP 300841, is a double strand necklace measuring approximately 18” in length featuring a genuine abalone shell disk pendant. The abalone disk pendant is embellished at the center with white metal and plastic seed beads. One strand of the necklace is composed of white metal with a filigree detail and antiqued plating. The second strand is made of a clear elasticized cord strung with plastic cylinder shaped beads. The closure of the necklace features a white metal chain extender with a lobster claw clasp. The necklace is valued at over 20 cents per dozen pieces.

The metal, abalone shell and plastic beads used to construct the necklace form a composite good. When the essential character of a composite good can be determined, the whole product is classified as if it consisted only of the part that imparts the essential character to the composite good. In this case, the abalone shell imparts the essential character to the good.

The applicable subheading for the Abalone Disk Necklace will be 7117.90.9000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Imitation jewelry: Other: Other: Valued over 20 cents per dozen pieces or parts: Other: Other.” The rate of duty will be 11% ad valorem.
