RE: The tariff classification of a woman’s tank styled garment from China

Dear Mr. Pascarella:

In your letter dated November 20, 2005, you requested a tariff classification ruling on behalf of Presidio International, Inc. The submitted sample will be returned to you as requested.

Style W5C690 is a woman’s upper body garment constructed from crocheted and woven components. The front neckline, upper back and shoulder straps are made from 100 percent rayon crocheted fabric while the body of the garment is constructed from 100 percent cotton woven fabric. The pullover garment extends below the waist and features a U-shaped front and rear neckline, a racer-like back and shoulder straps that measure 1 ½ inches wide. The essential character of the garment is imparted by the woven component.

The applicable subheading for style W5C690 will be 6211.42.0056, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of cotton: blouses, shirts and shirt-blouses, sleeveless tank styles and similar garments excluded from heading 6206: other. The duty rate will be 8.1 percent ad valorem.
